1. Eligibility & Capacity to Contract

By using GetAppTesters, you represent and warrant that you are at least 18 years of age or the legal age of majority in your jurisdiction, and possess the legal authority to enter into this agreement.

2. User Accounts & Security

When placing an order, an account is automatically provisioned using your provided email address. You are solely responsible for maintaining the confidentiality of your login credentials.

• You must provide a valid, active email address to receive critical testing updates.
• You are legally responsible for all activities that occur under your account.
• GetAppTesters reserves the right to suspend accounts suspected of fraud, unauthorized sharing, or policy violations.

6. Delivery & 14-Day Timeline

The timeline for our service is strictly defined to ensure compliance with Google's requirements.

• The 14-day testing period officially begins only after all required testers have successfully opted-in and installed your application.
• If a tester drops out due to technical issues, we will replace them at no extra cost to ensure the minimum required tester count is maintained.
• Delivery times for initial tester opt-in may vary based on current network capacity.

7. Payments & Refunds

All payments are processed securely. Due to the digital and labor-intensive nature of crowd-testing, strict payment rules apply.

• Payment is required upfront before testers are dispatched to your application.
• Refunds are governed by our separate Refund Policy. Once testers have begun the 14-day testing phase, the service is generally non-refundable.

8. Informal Dispute Resolution & Chargebacks

We are committed to resolving issues quickly and fairly. Before filing a formal dispute or bank chargeback, you agree to contact our support team to attempt an informal resolution.

• Filing a bank chargeback without first attempting resolution with GetAppTesters constitutes a material breach of these Terms.
• In the event of a breach-of-contract chargeback, we reserve the right to immediately suspend testing services and contest the dispute with evidence of service delivery.

9. Intellectual Property Rights

You retain 100% ownership of your Application, brand, and associated intellectual property.

• GetAppTesters claims no ownership, license, or rights to your Application beyond what is strictly necessary to perform the testing service.
• Our testers are bound by strict confidentiality agreements preventing the theft, copying, or reverse-engineering of your intellectual property.

10. Prohibited Applications

We reserve the right to refuse service and cancel orders for applications that violate ethical standards or Google policies.

• Apps facilitating gambling, crypto-scams, or unregulated financial services.
• Apps containing adult content, violence, or hate speech.
• Apps that attempt to deceive our testers or exploit their devices.

11. Indemnification

You agree to indemnify, defend, and hold harmless GetAppTesters and its testers from any claims, damages, liabilities, or expenses arising from your Application.

• This includes claims of copyright infringement, malware distribution, or violations of Google Play Developer Policies caused by your App.

12. Force Majeure & Platform Outages

GetAppTesters shall not be liable for any delays or failures in performance resulting from circumstances beyond our reasonable control.

• This includes, but is not limited to, Google Play platform outages, API changes, natural disasters, or catastrophic internet infrastructure failures.

13. Limitation of Liability

To the maximum extent permitted by applicable law, GetAppTesters shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

• This includes loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of our services.
• In no event shall our total liability exceed the total amount paid by you for the specific service giving rise to the claim.

14. Class Action Waiver

You agree that any dispute resolution or legal proceeding will be conducted strictly on an individual basis.

• You waive any right to participate in a class action lawsuit, class-wide arbitration, or representative proceeding against GetAppTesters.

15. Governing Law & Severability

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Termination of Service

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
